LEGAL NOTICE OF SALE UNDER POWER SATE OF GEORGIA COUNTY OF ROCKDALE By virtue of the power of sale contained in a Deed to Secure Debt given by RONALD KELLMAN and MARIE ROSE KELLMAN, dated April 30, 2013, and recorded in Deed Book 5368, Pages 245-254 on May 16, 2013, Rockdale County, Georgia, records, conveying the after-described property to secure a Note in the original amount of ONE-HUNDRED FIFTEEN THOUSAND AND 00/100 DOLLARS ($115,000.00) with interest thereon as set forth therein, there will be sold at public outcry for cash to the highest bidder before the courthouse door in Rockdale County, during the legal hours of sale on the first Tuesday in July, 2019 by THE GARICK GROUP, LLC, as Attorney-in-Fact for RONALD KELLMAN and MARIE ROSE KELLMAN the following described property, to-wit: ALL THAT TRACT OR PARCEL OF LAND lying and being in Land Lot 293 of the 16th District of Rockdale County, Georgia, being more particularly described as follows: BEGINNING at an iron pin found on the southwesterly right-of-way of Pineview Lane (having a 50’ right-of-way), 755.0’ northwesterly from the intersection formed by the southwesterly right-of-way of Pineview Lane and the northwesterly right-of-way of Shipp Circle (50’ right-of-way); running thence South 48 degrees 54’ 50” West 251.9’ to an iron pin found; running thence North 28 degrees 22’ West 58.7’ to an iron pin found; running thence North 39 degrees 40’ 40” East 256.8’ to an iron pin found on the southwesterly right-of-way of Pineview Lane; running thence southeasterly along the southwesterly right-of-way of Pineview Lane 100’ to an iron pin found and the point of beginning; being improved property known as 1542 Pineview Lane, Conyers, Georgia 30012 according to the present system of numbering houses in Rockdale County, Georgia, and being more particularly described on a survey for Perry E. McClung, Surveyor, dated April 16, 1985. This property is subject to a certain Security Deed from the Garick Group, LLC to the Farmers and Merchants Bank recorded in Deed Book 4852, Page 71, aforesaid records. The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured thereby. This sale will be made for the purposes of paying the same and all expenses of the sale, including attorney's fees, notice of intention to collect attorney's fees having been given as provided by law. The property will be sold as the property of the aforesaid Grantor subject to the following: (1) That certain security deed from The Garick Group, LLC to The Farmers and Merchants Bank recorded in Deed Book 4852, Page 71, Rockdale County, Georgia real estate records; (2) All prior restrictive covenants, easements, rights-of-way or encumbrances, (3) all valid zoning ordinances; (4) matters which will be disclosed by an accurate survey of the property; and (5) the outstanding ad valorem taxes and assessments, if any, unpaid water and sewage bills, that constitute liens against the property, whether due and payable or not yet due and payable, (6) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and any other matters of record superior to the Security Deed.
