Littering leads to drug, weapons charges

CONYERS - A plastic spoon thrown out a car window resulted in two Conyers men facing drug and weapons charges.

According to a report from the Rockdale County Sheriff’s Office, about 2:30 p.m. on Aug. 15, a deputy was on Sigman Road near the Bridlewood Apartments when he noticed the passenger in a 2001 Honda Accord throw something out the window as the vehicle entered the complex.

The deputy initiated a traffic stop. When he asked the driver, identified as Adam Ja’Karey Ellis, 20, and the passenger, identified as Caleb Javon Wilson, 19, if they knew why he had stopped them, Wilson stated he knew they had been stopped because he had thrown a plastic spoon out the window. Wilson said he would go pick up the spoon to avoid a citation, and the deputy advised him he would not be writing a citation, but not to litter again.

The deputy asked them for their identification. He reported the odor of marijuana coming from the vehicle and asked Ellis when the last time was there had been marijuana in his vehicle. Ellis allegedly said the previous week.

The deputy radioed for assistance and told Ellis and Wilson that the vehicle was going to be searched due to the odor coming from it. He asked them if they had any drugs or weapons in the vehicle, and they both allegedly said no.

When a second deputy arrived, they asked the two to exit the vehicle and sit on the push bumper of one of the patrol vehicles. Ellis complied, but Wilson allegedly reached back inside the vehicle for a camera case. When the deputy told him to leave the bag in the car, he reported that Wilson allegedly refused to drop the bag, so the deputy took to it from him.

The deputy told Wilson he was making him nervous that he was going to handcuff him. As the deputy grabbed Wilson’s right wrist, Wilson allegedly broke away and ran up into the woods. The deputy pursued him, but lost contact with him.

Back at the traffic stop, two deputies searched the vehicle. Inside the camera bag the deputy had taken from Wilson, they allegedly found a clear plastic container with a green leafy substance believed to be marijuana, a digital scale, a handgun, and other items.

A black book bag found on the back passenger seat allegedly contained Ellis’ wallet, a clear glass jar containing a green leafy substance suspected of being marijuana, and another handgun.

Ellis was placed under arrest and transported to the Rockdale County Jail. He was charged with possession of marijuana with intent to distribute, possession and use of drug related objects, and possession of a firearm during the commission of a felony.

Wilson was located and arrested on Aug. 25. He has been charged with possession of marijuana with intent to distribute, possession and use of drug-related objects, possession of a firearm during the commission of a felony, willful obstruction of law enforcement, and theft by receiving stolen property.
